The HIPAA Privacy Rule, issued by the U.S. Department of Health and Human Services (HHS), addresses the use and disclosure of protected health information by covered entities, and the HHS Office for Civil Rights enforces HIPAA rules. GDPR Article 9 treats health data as a special category whose processing is prohibited unless an exception applies, such as explicit consent or the provision of health care. The European Health Data Space Regulation entered into force on 26 March 2025, with obligations phased in from 2027.
